This End User License Agreement (“Agreement”) and Terms of Use (“Terms”) form a legal contract between you (“User”, “you”) and 366 Degree FitTech & Science Institute Inc. (“Company”, “we”, “us”, “our”), governing your access to and use of the ONE AI Agent mobile application (“App”) and related services (“Services”).

By downloading, installing, or using the App, you agree to be bound by this Agreement and Apple’s Standard App Store EULA (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
If you do not agree, do not install or use the App.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this Agreement and applicable platform terms.
You may not copy, modify, reverse-engineer, or distribute any part of the App or its content.

ONE AI Agent provides:

• Personalized meal and nutrition plans based on user goals, preferences, and optional biomarker/bloodwork data.
   
• AI-driven fitness and wellness recommendations.
   
• Integration with third-party grocery and retail partners (e.g., Kroger, Instacart).
   
• SMS accountability and progress-tracking features.
   
• Concierge services for locating nearby restaurants, gyms, and wellness centers.
   

ONE’s personalization is based on emerging research linking biomarkers, physiology, and nutrition, aiming to help users optimize their wellness habits through informed insights.

ONE AI Agent offers subscription-based access to premium features.

• Automatic Renewal: Subscriptions renew automatically unless canceled at least 24 hours before renewal through your App Store or Google Play account settings.
   
• Free Trial: A 3-day free trial may be provided; cancellation before the trial ends prevents automatic billing.
   
• Billing: All payments and renewals are handled through the App Store or Google Play. We do not store or process payment data.
   
• Refunds: Managed according to Apple or Google’s policies.
   
• Price Changes: We reserve the right to update subscription prices with prior notice.
   

The ONE AI Agent provides recommendations based on your fitness, nutrition, or optional biomarker data.
It is intended solely for informational, educational, and wellness purposes.

ONE does not:

• Diagnose, treat, cure, or prevent disease.
   
• Replace consultation with a physician, registered dietitian, or healthcare provider.
   
• Guarantee specific fitness or health outcomes.
   

Always consult your physician before beginning any diet, supplement, or exercise program.
If you experience adverse symptoms, stop using the App and seek medical attention immediately.

ONE’s personalization engine is informed by scientific literature suggesting that biomarker- and physiology-based nutrition may support better dietary adherence and wellness outcomes.
While these studies inform ONE’s educational approach, the Company does not claim clinical validation or medical efficacy.

• No personal, clinical, or biometric data is shared or sold.
   
• Please review the Privacy Policy for full details on how your data is collected, stored, and processed.
   

All AI models, design elements, and proprietary algorithms within ONE AI Agent are owned by 366 Degree FitTech & Science Institute Inc.
You receive no ownership rights beyond the limited license described herein.

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the App—including health, dietary, or fitness outcomes.
ONE AI Agent is provided “as is” and “as available” without warranties of any kind.

You agree to defend, indemnify, and hold harmless 366 Degree FitTech & Science Institute Inc., its affiliates, employees, and licensors from any claims, damages, or losses resulting from misuse of the App or violation of this Agreement.

We may suspend or terminate your access without notice if you breach these Terms or misuse the App.
Upon termination, delete all copies of the App from your device.

This Agreement shall be governed by the laws applicable in the country or region where you reside. However, the developer, 366 Degree FitTech & Sci Institute, operates under the laws of New York, United States which will govern any disputes not otherwise required by applicable consumer protection laws.

We may modify these Terms periodically.
Continued use after such updates constitutes acceptance of the revised Agreement.
